1. ACCEPTANCE OF TERMS
Welcome to Artec (”App,” “Service,” “we,” “us,” or “our”), operated by Artec Studio LLC (”Company”), a Florida limited liability company. By downloading, accessing, or using the Artec mobile application, you (”User,” “you,” or “your”) agree to be bound by these Terms of Service (”Terms”). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and the Company. Please read them carefully before using our Service.
2. SERVICE DESCRIPTION
2.1 Core Functionality
Artec is an AI-powered video analysis platform designed for content creators. The Service provides:
Video Analysis: AI-powered analysis of your video content using Google Gemini AI technology to assess viral potential, hook effectiveness, body retention, and call-to-action strength
Content Ideas: AI-generated content suggestions based on your uploaded videos
AI Chat Assistant: An interactive AI assistant providing personalized content creation advice across multiple modes (Viral, UGC, TikTok Shop)
Performance Tracking: Historical analysis of your content performance, including streak tracking and improvement trends
Push Notifications: Alerts about completed analyses, streak reminders, and content suggestions
2.2 Analysis Modes
The Service offers three distinct analysis modes:
Viral Mode: Optimization for mass appeal, engagement, and algorithmic reach
UGC Mode: Analysis for authentic, brand-friendly user-generated content
TikTok Shop Mode: Evaluation focused on product showcasing and conversion optimization
2.3 AI-Generated Content Disclaimer
IMPORTANT: All analysis, scores, suggestions, and recommendations provided by Artec are generated by artificial intelligence and are provided for informational and entertainment purposes only. AI-generated content:
Does not guarantee any specific results, including views, engagement, or revenue
May not be accurate, complete, or suitable for your specific circumstances
Should not be relied upon as professional advice (marketing, legal, financial, or otherwise)
May vary in quality and relevance based on the content analyzed
You acknowledge that viral potential scores, expected view ranges, brand value estimates, and all other metrics are algorithmic predictions and not guarantees of actual performance.
3. ELIGIBILITY AND ACCOUNT REGISTRATION
3.1 Age Requirements
You must be at least 13 years of age to use this Service. If you are under 18 years of age, you represent that you have your parent’s or legal guardian’s permission to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.
3.2 Account Types
The Service offers multiple authentication methods:
Guest Account: Temporary anonymous access with limited data persistence
Email/Password Account: Full account with email verification
Social Sign-In: Authentication via Apple, Google, or TikTok
3.3 Account Security
You are responsible for:
Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access or security breach
Ensuring your authentication credentials are not shared with third parties
3.4 Account Information Accuracy
You agree to provide accurate, current, and complete information during registration and to update such information as necessary to maintain its accuracy.
4. USER CONTENT
4.1 Definition
“User Content” includes all videos, scripts, text, and other materials you upload, submit, or transmit through the Service.
4.2 Your Rights and Responsibilities
You represent and warrant that:
You own or have the necessary rights, licenses, and permissions to upload and share all User Content
Your User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party
Your User Content complies with all applicable laws, regulations, and these Terms
You have obtained all necessary consents from individuals appearing in your videos
4.3 License Grant to Artec
By uploading User Content, you grant Artec Studio LLC a worldwide, non-exclusive, royalty-free, sublicensable license to:
Process, analyze, and store your User Content for the purpose of providing the Service
Transmit your User Content to third-party AI services (specifically Google Vertex AI/Gemini) for analysis
Generate and store analysis results, feedback, and derivative insights
Use anonymized and aggregated data derived from User Content for Service improvement
This license is limited to the purposes of operating and improving the Service and does not grant us the right to sell your User Content or use it for advertising without your explicit consent.
4.4 Content Restrictions
You agree not to upload, submit, or transmit User Content that:
Contains sexually explicit or pornographic material
Depicts violence, abuse, or harm to humans or animals
Contains hate speech, harassment, or discrimination
Infringes on copyrights, trademarks, or other intellectual property rights
Contains malware, viruses, or malicious code
Violates any applicable law or regulation
Impersonates another person or entity
Contains false or misleading information
4.5 Content Removal
We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, to be inappropriate, without prior notice.
4.6 Video Duration and Storage
Videos are limited to 5 minutes (300 seconds) maximum duration
Videos are stored in Firebase Cloud Storage for the purpose of AI analysis
You may delete your videos at any time through the app interface
5. SUBSCRIPTION AND PAYMENT TERMS
5.1 Subscription Service
Artec offers premium features through paid subscriptions. Subscription purchases are processed through the Apple App Store and managed via RevenueCat.
5.2 Billing and Payment
All payments are processed by Apple through your App Store account
Subscription fees are billed in advance on a recurring basis (weekly, monthly, or annually, depending on your selected plan)
Prices are in the currency associated with your App Store account
You authorize us to charge your selected payment method for all applicable fees
5.3 Auto-Renewal
Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. You can manage and cancel your subscription through your Apple ID account settings.
5.4 Price Changes
We reserve the right to change subscription prices upon reasonable notice. Price changes will not affect the current billing period and will take effect at the next renewal.
5.5 Refunds
Refund requests are handled according to Apple App Store policies. We do not directly process refunds. To request a refund, contact Apple Support through your App Store account.
5.6 Free Trials
If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless you cancel before the trial ends. You will not be charged during the free trial period.
6. THIRD-PARTY SERVICES
6.1 Third-Party Integrations
The Service integrates with the following third-party services:

6.2 Third-Party Terms
Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or policies of these third-party services.
6.3 AI Processing Disclosure
Your video content is transmitted to Google’s Vertex AI (Gemini) servers for processing. By using our Service, you consent to this transmission and processing. Google’s use of this data is governed by Google’s terms of service and privacy policy.
7. INTELLECTUAL PROPERTY
7.1 Artec’s Intellectual Property
The Service, including its design, features, functionality, content, and all related intellectual property rights, are owned by Artec Studio LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.
7.2 Feedback
If you provide feedback, suggestions, or ideas about the Service (”Feedback”), you grant us an unlimited, irrevocable, perpetual, sublicensable, transferable, royalty-free license to use such Feedback for any purpose without compensation to you.
7.3 AI-Generated Analysis
Analysis results, scores, and recommendations generated by our AI are provided to you for your personal, non-commercial use. You may use these results to improve your content but may not resell or redistribute them as a standalone service.
8. PRIVACY AND DATA
8.1 Privacy Policy
Your use of the Service is also governed by our Privacy Policy, available at

8.2 Data Collection
We collect and process:
Account information (email, display name, profile photo)
Video content and associated metadata
Chat conversations and AI interactions
Usage analytics and device information
Push notification tokens
Subscription status
8.3 Data Portability
You may request an export of your data at any time through the app’s Profile section (“Request My Data” feature). Exported data includes your profile, videos, and chat history.
8.4 Account Deletion
You may delete your account at any time through the app’s Profile section. Upon deletion:
All personal data, videos, and chat history will be permanently removed
This action is irreversible
Deletion may take up to 30 days to propagate through all backup systems
9. PROHIBITED CONDUCT
You agree not to:
Violate any applicable laws, regulations, or these Terms
Use the Service for any fraudulent or unlawful purpose
Attempt to gain unauthorized access to the Service, other accounts, or related systems
Interfere with or disrupt the Service or servers/networks connected to the Service
Use automated systems (bots, scrapers, etc.) to access the Service without permission
Reverse engineer, decompile, or disassemble any aspect of the Service
Remove, circumvent, or disable any technological protection measures
Use the Service to generate content for competitors or competing products
Misrepresent your identity or impersonate others
Upload content that violates third-party rights or applicable laws
Abuse or exploit any bugs, glitches, or vulnerabilities in the Service
Resell, redistribute, or commercialize access to the Service without authorization
10. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
MERCHANTABILITY: We do not warrant that the Service is fit for any particular commercial purpose
FITNESS FOR A PARTICULAR PURPOSE: We do not warrant that the Service will meet your specific requirements
NON-INFRINGEMENT: We do not warrant that the Service does not infringe any third-party rights
ACCURACY: We do not warrant that analysis results, viral scores, or recommendations are accurate or reliable
AVAILABILITY: We do not warrant that the Service will be uninterrupted, timely, secure, or error-free
RESULTS: We do not warrant that use of the Service will result in increased views, engagement, followers, or revenue
AI LIMITATIONS: AI-generated content may contain errors, biases, or inaccuracies. You acknowledge that AI technology has inherent limitations and that results should be independently verified.
11. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
11.1 Exclusion of Damages
IN NO EVENT SHALL ARTEC STUDIO LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:
Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Cost of substitute goods or services
Any damages arising from your use or inability to use the Service
Any damages resulting from AI-generated analysis or recommendations
Any damages from unauthorized access to or alteration of your content
11.2 Cap on Liability
OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE GREATER OF:
The amount you paid to us in the twelve (12) months preceding the claim, or
One hundred U.S. dollars ($100.00)
11.3 Jurisdictional Limitations
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Artec Studio LLC, its members, managers, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
Your use of the Service
Your User Content
Your violation of these Terms
Your violation of any rights of any third party
Your violation of any applicable laws or regulations
Any claim that your User Content caused damage to a third party
13. TERMINATION
13.1 Termination by You
You may terminate your account at any time by using the “Delete My Account” feature in the app or by contacting us at contact@shareartec.com.
13.2 Termination by Us
We may suspend or terminate your account immediately, without prior notice, if:
You breach any provision of these Terms
We are required to do so by law
We discontinue the Service
We detect fraudulent, abusive, or illegal activity
13.3 Effect of Termination
Upon termination:
Your license to use the Service is revoked
We may delete your account and User Content
Provisions that by their nature should survive termination will survive (including Sections 4.3, 7, 10, 11, 12, and 14)
14. DISPUTE RESOLUTION
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
14.2 Informal Resolution
Before initiating any formal dispute resolution proceeding, you agree to first contact us at contact@shareartec.com to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days of receipt of your notice.
14.3 Binding Arbitration
If informal resolution is unsuccessful, any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted in English in the State of Florida, and the arbitrator’s decision shall be final and binding.
14.4 Class Action Waiver
YOU AND ARTEC STUDIO LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
14.5 Small Claims Exception
Notwithstanding the foregoing, either party may bring an individual action in small claims court.
14.6 Opt-Out
You may opt out of binding arbitration within 30 days of accepting these Terms by sending written notice to contact@shareartec.com with your name, email, and statement of intent to opt out.
15. DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA)
15.1 DMCA Compliance
We respect the intellectual property rights of others and expect users to do the same. We will respond to notices of alleged copyright infringement that comply with the DMCA.
15.2 DMCA Notices
If you believe your copyrighted work has been infringed, please provide the following information to our DMCA Agent:
Identification of the copyrighted work claimed to be infringed
Identification of the infringing material and its location
Your contact information (name, address, telephone number, email)
A statement of good faith belief that the use is not authorized
A statement, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

15.4 Counter-Notification
If you believe your content was removed in error, you may submit a counter-notification with the required information under the DMCA.
16. GENERAL PROVISIONS
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Artec Studio LLC regarding the Service and supersede all prior agreements.
16.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
16.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations without restriction.
16.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights.
16.6 Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, or government actions.
16.7 Notices
We may provide notices to you via the app, email, or through the Service. You may provide notices to us at contact@shareartec.com.
17. MODIFICATIONS TO TERMS
17.1 Right to Modify
We reserve the right to modify these Terms at any time. When we make material changes, we will:
Update the “Last Updated” date at the top of these Terms
Notify you through the app or via email
Provide reasonable advance notice before changes take effect
17.2 Continued Use
Your continued use of the Service after changes become effective constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.
